Is using buyable copyrighted midi music legal in Zelda Classic quests?

If yes what links will prove yes?


If no without permission then where are websites to go to get license type permission to use such midi music?

If I'm not mistaken, Midis based on copyrighted songs are considered a derivative work. They're not considered illegal like downloadig an mp3 file of a copyrighted song. If you're using a midi based on someone else's work for commercial reasons, that would be illegal, but Zelda Classic quests are nonprofit as is, so it shouldn't be an issue to use midis so long as the midi files in question were put online to download for free for noncommercial use.

Midis by nature are derivative since they are not accurate sounding to the original song they are based on. So I'd use them. It's not like we're making money off of these quests anyway and our community is so niche and small, nobody will notice or care.

I am a lawyer and I think DFW is on target.  Even on the remote chance of some copyright infringement question, ZC is so off the radar the chances of a problem are between slim and none.  And all one would ever get is a C&D letter, they'd remove that music from the quest, and problem solved.
